Legal and Tax Issues

If you have a web site you should be concerned about the legality of your site.

It's easy to copy portions of someone else's website or to copy images from another site and use them on your site. But, unless you have permission to do so, you may well be violating the legal rights of the owner of the other site.

Copyright law protects works created by others. This means that you can be prosecuted for using created material without permission.

Copyright law protects websites and the images on those sites. Even if the page does not display copyright information, the material is covered by copyright law and the rights of the owner can be enforced by law.

You may also use certain words on your site or create pages on your site using words or names that are trademarked by someone else. A trademark protects words or phrases that are associated with a particular product or service. Your use could result in legal action to restrict your use and recover damages.

If your site makes money, you will probably be liable to pay income taxes. As part of paying income taxes you should file quarterly statements with the IRS to pay an estimated amount of tax.

These and other considerations should be the concern of every webmaster. While you may escape legal action most of the time, eventually someone will notice what you are doing and follow up with legal action.

The best thing to do is to know and understand the law related to your web presence.
